QUALIFICATION OF UNCOMPLETED CRIMES, COMMITTED IN CONSPIRACY WITH THE DISTRIBUTION OF ROLES

Abstract

The article clarifies the qualifications actions of the organizer, instigator and accessory in the uncompleted nature of the actions of the perpetrator with positions equivalent of the concept of accessory liability. In accordance with this concept the acts of conspirators, should be classified according to the nature and extent of the completion of the organizer, instigator and acctssory. A new approach for the qualification of uncompleted crimes, committed in complicity with the distribution of roles, will allow to eliminate contradictions of the criminal legal requirements formulated within the institutions of the unfinished crime (article 30 of the Criminal Code) and conspiracy to a crime (article 34 Criminal Code).
